Please read carefully before using ecksand.com. These Terms and Conditions govern the sale of merchandise by BIJOUX ECKSAND INC. Your use of ecksand.com to purchase merchandise or otherwise indicates your agreement to follow and to be bound by these Terms and Conditions, our Privacy Policy, our Disclaimer and other notices which may be posted on ecksand.com and all applicable laws and regulations. Any user who does not comply with the terms listed below should not continue to browse or use the services of ecksand.com. Ecksand's order confirmation and these Terms and conditions shall be the final and integrated agreement between Ecksand and you on the matters contained in these Terms and Conditions.


Authenticity Guarantee


Ecksand guarantees the authenticity of all products purchased on ecksand.com. Every item is delivered with a certificate of authenticity.


Governing Law


This website is controlled and operated by BIJOUX ECKSAND INC. located in the city of Montreal, Province of Quebec, Canada. Any disputes between this website and a visitor or customer must be resolved in a competent legal court of law in the city of Montreal, province of Quebec, Canada. Ecksand records evidence of all transactions between ecksand.com and its customers. In the event of a dispute between ecksand.com and one of its customers relating to a transaction, the data recorded by ecksand.com shall be treated as evidence of the details of the transaction.


Shipping and Handling


The confirmation of order will be sent by email. All shipped packages are insured for the full value of the transported items. All of our packages require an adult signature upon delivery. All in-stock items will be processed and sent within a maximum of 30 business days. Custom engagement rings, custom wedding rings, and custom ring orders will take a minimum of three weeks. Ecksand is not liable for unforeseen consequences that might delay the processing and/or the shipping of the package. Ecksand reserves the right to divide the order into partial shipments. In this case, the customer’s credit, charge or debit card will only be charged for a single shipment. Please note that your order will be shipped to the billing address. Ecksand reserves the right to cancel orders that do not meet specific criteria, such as orders with different billing and shipping addresses. For more information, please contact sales@ecksand.com. Any failure to deliver or a delivery exceeding the informed delivery date should be reported to sales@ecksand.com. If the products ordered do not conform to the original order, or you are unsatisfied, please refer to the Ecksand Return Policy. The customer accepts all risk for the goods (including loss, theft, or damage to any order) upon shipment.


Return and Exchange Policy


Your satisfaction is our top priority, and we’ll do everything to ensure that your Ecksand jewel surpasses your expectations. If you need to return your Ecksand order, we’ve got you covered. Returns are accepted within 10 days from the date of availability (total refund excludes a 5% restocking fee). Beyond this time frame, all sales are considered final, and no returns will be accepted. Before returning your jewel, see if your order qualifies for a return in our Return policy here.


Ecksand reserves the right not to accept returns ten days from the date of availability. All returns and exchanges are subject to a quality assurance inspection process before they are accepted. Any jewel with signs of damage, wear or alteration (e.g. resized ring by a jeweller other than Ecksand) cannot be accepted. Ecksand reserves the right to refuse exchanges on any items that have been worn or altered in any way. If you are not satisfied with the item that was sent to you, please contact us immediately. Please ensure that returned items are in their original box and packaging with full documentation. Please ship all item(s) pre-paid and fully insured. Ecksand is not responsible for the loss or damage of returned shipments. PLEASE NOTE: Custom Made Ring orders are final and non-refundable for more information, please contact sales@ecksand.com.


Prices and Payments


The prices of Ecksand products are indicated in CA$, excluding taxes and shipping costs. Ecksand.com charges federal and provincial taxes to QC customers, federal taxes to other Canadian provinces and no taxes for US orders as required by applicable law. Orders are shipped from our offices in Montreal, Quebec, Canada. International shipments may be subject to duties and/or fees, which are determined by the appropriate government agency. Buyers are fully responsible if shipments are subject to duties, taxes or brokerage fees upon arrival. Ecksand reserves the right to modify the price of products offered on the Site at any time without prior notice to the customer. The customer will be charged the prices displayed on this Site at the time the order was confirmed, provided that the products are available at that time. The customer is required to pay for any order placed on the Site immediately upon confirmation. At the moment, we can only accept payment by credit cards or PayPal and financing through Affirm*. Be sure to provide us with the exact credit card number, expiration date, PIN number, security code and billing address that your credit card issuer has on file. Your order will only be dispatched once Ecksand has verified your payment method, verified the provided information and received authorization to process your payment. The customer’s credit, charge or debit card will only be charged when their order is dispatched. If any of the products in the order are unavailable, Ecksand will only charge the price, taxes and shipping costs for the goods available.


Custom Made Rings


You acknowledge that you are responsible for any material you may submit via the Ecksand custom-made ring form. If you do submit material, and unless we indicate otherwise, you grant Ecksand and its affiliates an unrestricted, non-exclusive, royalty-free, perpetual and irrevocable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display such material throughout the world in any media. You further agree that Ecksand is free to use any ideas, concepts, or know-how that you or individuals acting on your behalf provide to Ecksand. You grant Ecksand and its affiliates the right to use the name you submit in connection with such material if they so choose. You represent and warrant that you own or otherwise control all the rights to the content you post; that the content is accurate; that use of the content you supply does not violate any provision herein and will not cause injury to any person or entity; and that you will indemnify Ecksand for all claims resulting from content you supply.


Limitations of Liability


Under no circumstance whatsoever shall BIJOUX ECKSAND INC. be liable for any loss arising out of or in connection with the use of the website ecksand.com. Other than as required by applicable consumer protection law or insurance law, if any, in no event will Ecksand be liable for errors or omissions in this information or for any losses or damages, direct, indirect, incidental, special or consequential resulting from your use or misuse of, or reliance on, any such information. Ecksand may process your personal data without your consent when such processing is necessary to comply with applicable laws and regulations or to provide you with services you requested, including the purchase of products on ecksand.com. Products ordered by customers will remain the property of Ecksand until Ecksand has received full payment thereof. If there is any problem with payment, the customer is responsible to return the goods received to Ecksand immediately upon request.


Disclaimer


Rarely do we encounter identical gemstones, diamonds or pearls; therefore, Ecksand creations are one of a kind. When ordering one or more of the same item, the gems might slightly differ from the online picture. While jewels shipped should match in basic form, shape, and appearance, there is always a chance that models will be updated with the most resembling set of gems. The differences might not be visible to the naked eye. If there are any inquiries concerning the disclaimer, please do not hesitate to contact sales@ecksand.com. While every effort is made to ensure that the colour, design, and style of the jewelry displayed on ecksand.com are representative of the original products, slight variations may occur for technical and other reasons.


Security Measures


Ecksand.com utilizes the latest version of Secure Socket Layer Technology [SSL] to encrypt your personal information. We have also adopted physical, electronic and administrative security measures to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access and against other unlawful forms of data processing, as provided in our Privacy Policy. Nevertheless, Ecksand does not guarantee that the security measures adopted for the protection of the transmission of data and information through ecksand.com will prevent or exclude any risk of unauthorized access or loss of data. It is advisable that your computer is equipped with software devices for the protection of network data transmission and receipt (such as updated antivirus systems) and that your Internet service provider takes appropriate measures for the security of network data transmission (such as firewalls and anti-spam filtering).


While Ecksand takes commercially reasonable efforts to safeguard the privacy of your information in accordance with this Privacy Policy, in no event will the information you provide to us create any fiduciary obligations to you on our part. It will not result in any liability to you on our part in the event any such information is inadvertently released by us or accessed by third parties without our consent. Ecksand.com is committed to data security with respect to information collected on our site during your shopping experience.
